The Los Angeles Innocence Project has filed a petition to overturn Peterson’s conviction, citing new scientific evidence and witnesses who support his innocence.
Attorneys with the Innocence Project argue that the break-in at the Medina home across the street from the Petersons’ and the subsequent arson of the burglars’ van were not properly investigated. They also allege potential Brady violations by the Modesto Police Department and the Stanislaus County District Attorney's Office.
The attorneys further claim that medical research has advanced since Peterson’s conviction and now indicates Conner’s fetal growth was consistent with a date of death later than prosecutors presented at trial. Prosecutors maintain that Conner was likely expelled from Laci’s decaying body shortly before the remains were discovered.

He was originally sentenced to death for the murders of his wife, Laci Peterson, and their unborn son, Connor, but that sentence was later overturned. The court determined that Peterson's trial judge improperly dismissed jurors who opposed capital punishment. He was resentenced to life without the possibility of parole.
Now, a California judge is granting Scott Peterson discovery rights, 20 years post-conviction. The defense team believes these materials could support their claims of trial irregularities and potential evidence mishandling. The judge rejected several requests from Peterson's team for specific evidence while approving others.
The Los Angeles Innocence Project and Scott Peterson want to test other items related to a burglary near their home that they believe are connected to the case. Their current theory is that Laci was abducted and killed by burglars who broke into a home across the street from the Petersons' on Christmas Eve 2002. This theory is based on the idea that Laci was still alive after Scott left to go fishing because multiple witnesses saw her walking her dog in the neighborhood.
DNA testing is also being conducted on a piece of duct tape found on Laci Peterson’s remains

Peterson says he expected to be home after court until the verdict was read. Responding to allegations that he killed Laci because he didn't want to be married, Peterson states, "That's so offensive, that's so disgusting. I just don't get that argument, and it's absolutely not true." He admits to regretting his infidelity, acknowledging that he was an "a--hole," but insists he did not kill his wife.

Netflix is debuting American Murder: Laci Peterson, a three-part docuseries directed by Skye Borgman. The series includes Laci's mother, Sharon Rocha, speaking publicly for the first time since Laci’s tragic death. The second documentary, Face to Face with Scott Peterson, is a new three-part series premiering on Peacock on August 20. In this series, Scott Peterson, who was accused of the murder, speaks for the first time in the 21 years since his arrest.
Peterson reportedly admits to being unfaithful, calling himself a “total a-hole” for having an affair, but continues to deny killing Laci. Peterson was involved with Amber Frey at the time of Laci's disappearance. It was Laci’s stepfather, Ron Grantski, who reported her missing, not her husband. Initially, Scott Peterson told friends he had gone to play golf, but later changed his story to say he went fishing. Peterson has been fighting for years to overturn his conviction.
Although his death sentence was initially overturned, the California Supreme Court upheld his conviction while overturning the death sentence due to the improper dismissal of some jurors based on their views on the death penalty. Peterson remains in prison, sentenced to life without parole, but he is not giving up. In an effort to secure a new trial, Scott Peterson's legal team requested DNA testing on more than a dozen pieces of evidence.
However, after hearing the arguments, the judge ruled that only a single 15.5-inch piece of duct tape found on Laci Peterson's pants during her autopsy would be tested for DNA. The court denied requests to test all other evidence.
