Morphew is soft-spoken in a cream-colored sweater and light-wash jeans, sitting next to attorneys David Beller and Jane Fisher-Byrialsen. His daughters, Mallory and Macy, sat behind him in the first row.
Beller enters a not guilty plea on Morphew's behalf.
Maintaining his innocence in his wife’s murder, Morphew waives his right to a speedy trial. Defense attorneys and prosecutors, agreeing on the large amounts of data, anticipate that the length of the proceedings requires more time to prepare.
The judge sets October 13 for Morphew’s jury trial; it is expected to run up to six weeks.
Barry Morphew was originally charged with the murder of his wife in May 2021, but the case was dropped days before trial, after the judge barred prosecutors from calling key witnesses to the State's case, for failing to follow rules in turning over evidence.
Former 11th Judicial District Attorney Linda Stanley was later disbarred by the Colorado Supreme Court for significant ethical misconduct. Stanley made inappropriate comments in the media and even improperly investigated the judge in the case.
Her actions compromised the Morphew prosecution and led to disciplinary action.

In 2021, Morphew was charged with first-degree murder and tampering with physical evidence after his wife, Suzanne, went missing on Mother's Day in 2020, but those charges were later dropped before his trial date and a year before Suzanne's remains were found.
Suzanne Morphew, 49, was last seen on Mother's Day, May 10, 2020, in Maysville, Colorado, after leaving her home for a bike ride. Later that evening, Suzanne's mountain bike is found near the home, and her helmet is found in a different location nearby a few days later.
A massive search for Suzanne spans over a three-year period until her remains are uncovered in a shallow grave in Saguache just a few hundred feet down a dirt road, the indictment states. An autopsy report states drugs typically used to tranquilize animals were found in her system.
Morphew was all smiles at his court appearance.

The toxicology report shows several drugs found in her system at the time of her death: Butorphanol, a synthetic opioid pain-killer, Azaperone, a sedative commonly used as a tranquilizer for pigs and elephants, and medetomidine, a sedative that can decrease an animal's heart rate, commonly used by veterinarians.
According to a 2021 affidavit, Barry Morphew admitted to police that he frequently used BAM and other tranquilizers to sedate deer to remove antlers for his hunting business. However, BAM is the commonly used abbreviation for Butophanol, Azaperaone, and Medetomidine. Azaperone is used as a sedative for Elephants, Rhinoceros, and Giraffes, while Medetomidine facilitates immobilization of large carnivores and great apes.
Police say in the recovery of Susanne Morphew's body, her favorite tee-shirt was pulled from the location. And in the past few days, it's reported that husband Barry Morphew quietly slipped into an invite-only memorial for his murdered wife.
